On December 5, 2025, the 74th executive meeting of the State Council approved the "Regulations on Administrative Law Enforcement Supervision" and promulgated it as State Council Decree No. 825. It will be implemented nationwide from February 1, 2026. For the first time, the regulation regulates the enforcement of electric vehicles in the form of national legislation, clearly listing the management of electric vehicles and tricycles as key supervision objects, and delineating three major enforcement red lines: ① It is strictly prohibited to impose a "one size fits all" ban on driving, selling, and punishing, and all regions shall not impose restrictions on compliant vehicles without basis. Rural agricultural tricycles and urban livelihood distribution vehicles must ensure legal road rights; ② It is strictly prohibited to use punishment as a substitute for management or to enforce laws for profit. It is also forbidden to stop inspections, arbitrarily detain or punish without proper procedures. Law enforcement must balance legality with safeguarding people's livelihoods; ③ Non standard vehicles are not allowed to be "suddenly banned", and a reasonable transition period must be set up, with free registration and filing. During the transition period, there will be no deduction or punishment, and at the same time, a subsidy for trade in will be provided to guide the replacement. The regulations require that law enforcement be open and transparent throughout the entire process. Car owners can file complaints and reports of violations, and supervisory departments need to verify and provide feedback within a specified period of time to thoroughly solve pain points such as "one location, one regulation, cross city fines, and arbitrary blocking", and protect the legitimate rights and interests of 400 million electric vehicle owners.
